The U.S. District Court, Eastern District of Louisiana ruled in favor of Insurance Companies on Friday.
This ruling was brought about by several motions filed by insurance companies to dismiss the claims made by home owners with defective drywall installed in their homes.
The insurance companies used every tactic possible to avoid paying claims for damages caused by Chinese Drywall being installed in homes throughout the U.S. These tactics included exclusions from coverage for "latent defects" to "environmental".
Ultimately, the arguments placed by the insurance companies convinced the federal court to declare that Chinese Drywall is a "Faulty Material". Therefore, excluding the damages from coverage by the home owners' insurance policies!
Once again, the home owner is left to fight foreing companies in order to help fix the dream homes they bought during our building boom! Who wins? The big insurance companies win.
