COUNTERFEIT GIBSON GUITAR BUST
Counterfeit Guitar Bust Yields 861 Gibson Fakes, Ends with Prison Sentence

The recent arrest and three-year jail sentencing of Beijing’s Li Dan was a monumental victory against the proliferation of counterfeit guitars. Not only were 1,200 fake guitars seized, but years of efforts on the part of the Gibson, the Electric Guitar Anti-Counterfeiting Coalition (EGACC) – which consists of Fender, Gretsch, Ibanez and Paul Reed Smith – and Chinese legal authorities paid off, leading to the sentencing of Li Dan.

Dan operated paylessguitar.com.cn, paylessguitars.com, musoland.com.cn and musoland.com, web domains that targeted overseas consumers with alluringly inexpensive fake guitars advertised as authentic Epiphone, Fender, Gibson, Gretsch, Ibanez, and Paul Reed Smith brand guitars. Of the 1,200 guitars seized at Li Dan’s warehouse and retail outlet this past fall, 861 were Gibson and Epiphone branded.

The hosting companies for Li Dan’s Web sites responded to Gibson’s legal notices by shutting down her sites in 2007. Surprisingly brazen, Li Dan simply re-introduced them months later using new hosting companies. She also kept photos of herself on her Facebook page, and images of her attending guitar tradeshows were found on the Internet. It was a long road to Li Dan’s conviction, taking more than a year for the EGACC to successfully petition the Chinese government to assist in upholding the United States’ intellectual property laws.
In November 2008, Li Dan, her mother, her business partner Yu Hui, and four other business associates were arrested. (Li Dan’s mother was arrested because all of Li Dan’s collections were being routed through her mother’s bank account.)
At last the EGACC had accumulated enough evidence — testimony, shipping and sales records, etc. — for the Xuanwa District Court in Beijing to convict Li Dan. On May 6, 2009, she was sentenced to three years in prison.

Darrell Prescott, who represents the EGACC, said, “These follow-up actions by the Chinese authorities should make it abundantly clear to those who traffic counterfeit guitar products that they will pay a heavy price for their actions. While this case is closed, continued vigilance is required and the EGACC will continue to take swift, decisive action against this type of illegal activity in the future.”

The problem of counterfeit guitars certainly isn’t a new one. For many years Gibson has faced the battle head-on, taking aggressive action to shut down entities illegally masquerading as Gibson or using Gibson’s brand names and trademarks unlawfully.

Gibson’s Manager of Brand Protection Ric Olsen said that Gibson has continued to fight even as counterfeiters and infringers have become more prevalent and more cunning at fooling consumers.

“With the current economic conditions we’re seeing such an increased abuse of our brand names and intellectual property this year,” Olsen said. “It’s amazing what’s going on right now. It’s a free-for-all, and people are trying to get away with it. But Gibson is bearing down harder than ever on the enforcement and protection of our valuable brand names and trademarks. We won’t stop fighting this.”

Eliminating counterfeit guitars continues to be one of Gibson’s top priorities for many reasons, but mostly because it is so clearly a concern to so many of our consumers.

A couple of summers ago Gibson.com ran a consumer warning acknowledging the counterfeiting problem and offering tips about how to spot a fake Gibson. That story turned out to be one the most popular stories to ever be published on the site, receiving thousands of clicks each day. Consumers spoke loud and clear, and they’ve continued to. Each day, emails pour into Gibson’s Customer Service team, full of tips and complaints about counterfeiters. To cite one such example, a man recently wrote in to alert us to an illegal site. “When I was web-surfing I found an illegal Web site,” he said.“They sell imitation items of Gibson. I don’t want to see the imitation of my guitar. Terrible!”

To curtail the growing problem, Gibson advises all consumers to purchase Gibson instruments, or any other instrument from Gibson’s family of brands, only from our network of authorized dealers. Consumers are encouraged to contact Gibson’s Customer Service team, whether the guitar in question is new or used. “We have a wonderful customer service department,” says Olsen. “Anybody who questions anything they’re about to purchase should bring it to us.”

To report incidents, consumers should file a police report, and may also visit http://www.ic3.gov/.

For questions about a guitar’s authenticity, contact the Gibson Customer Service team at www.gibson. or 1-800-4GIBSON.

WISCONSIN COURT PRAISES DRUNKEN FESTIVAL GOER
MADISON, Wis. (AP) - Travis Peterson knew he was too drunk to drive home after an outdoor concert three years ago at Alpine Valley south of Milwaukee. So he fell asleep in his car, only to be awoken by a state trooper.

Peterson said even though he told the officer he was drunk and just sleeping it off, the trooper ordered him to leave because the lot was being cleared.
Once out of the parking lot, Peterson was arrested for drunken driving.

A state appeals court on Wednesday commended Peterson for trying to do the right thing by sleeping it off, and said the trial court was wrong not to let him argue that police had entrapped him.

M FOR MORE
Second CD Soundtrack from Award-Winning Blues Film "M for Mississippi" Now Available

(Clarksdale, MS) - The original soundtrack to the award-winning film "M For Mississippi" offered blues lovers a small taste of the raucous, wild sounds of today's Delta blues scene. Now a second volume of the soundtrack is available on CD, featuring a dozen never-before-released performances recorded during the filming of the critically acclaimed movie. Featured artists include T-Model Ford, Jimmy "Duck" Holmes, Big George Brock, Terry "Harmonica" Bean and Robert "Bilbo" Walker.

The new CD, titled "M For Mississippi: More Music from the Motion Picture," is a joint production of Broke & Hungry Records, Cat Head Delta Blues & Folk Art and Mudpuppy Recordings. The CD is currently available at www.mformississippi.com and will gain wider release later this summer.

More than a collection of leftovers, the songs on this new CD rival those on the first soundtrack. This is no accident, notes Jeff Konkel, one of the co-producers of the film and its two soundtracks. "We envisioned two soundtracks from the outset, so when it came time to divide the recordings, we deliberately set out to make two albums of equal caliber."

Among the many highlights of the new soundtrack is Robert "Bilbo" Walker's unreleased performance of "Johnnie B. Goode." "It's the song Chuck Berry didn't want you to hear," says Roger Stolle, another co-producer of the film and its soundtracks. "If you’ve seen the film, you know that Chuck Berry -- who controls his own publishing -- denied us permission to use the song in the movie. Fortunately, the law permits us to license the song for audio release. We think it was worth the wait."

Other highlights on the new soundtrack include L.C. Ulmer's haunting bottleneck workout "When I Was In Trouble," T-Model Ford's acoustic romp through "Hi Heel Sneakers" and Pat Thomas' quirky original "What A Way It Used To Be." The CD ends with an unreleased version of the film's title song featuring blues legend Big George Brock alone with his harmonica.

Since the release of "M For Mississippi: A Road Trip through the Birthplace of the Blues" late last year, the film has garnered sweeping praise and has earned numerous awards including a prestigious Blues Music Award for DVD of the Year. The film has been screened at film festivals throughout the United States and Europe.

"The reception and reviews we've received for the film and its soundtracks are truly humbling," said Kari Jones, the project's third co-producer. "It shows that, even in the 21st Century, the surviving blues of the Mississippi Delta is still a very relevant and inspiring music."

ONE HALF NOTE/ TWO TALENTS
Jimmy Rushing

Few buffs would describe the mid-1960s as a “golden age” of jazz. It wasn’t—not compared with the swing era or the early modern period. Yet this was an amazing time in the music’s history and the last point when nearly all the iconic giants were still with us (save those Bixes and Birds who died tragically young). If two new releases of previously unissued live performances by saxophonist Lucky Thompson and blues singer Jimmy Rushing are any indication, a disproportionate number of major musicians of the period appeared at New York’s old Half Note club at 289 Hudson St.

The South Carolina-born, Detroit-raised tenor saxophonist and composer Eli “Lucky” Thompson (1923-2005) was a man constantly on the move. He shuttled back and forth between the U.S. and Europe, and his style and approach were as changeable as his mailing address. Where most major players of his generation perfected a distinctive sound early in their careers and stuck with it for decades, Thompson evolved from big-band swing and early R&B to bebop to a very Euro-cool sonority in the 1950s—and by the mid-1960s to a sound that resembled no one else’s. In a sense, Thompson was one of jazz’s first postmodernists, and his unique music has had a strong influence on such contemporary players as the young saxists Mark Turner and Chris Byars, who frequently play Thompson’s compositions.

“New York City, 1964-65,” the new two-CD set of Thompson’s music from Montreal’s Uptown Records, presents two live shows—a concert in an Off-Broadway theater (underwritten, surprisingly, by Frank Sinatra’s right-hand man, Jilly Rizzo) and a less formal nightclub set with only a rhythm section at the Half Note. The first features Thompson’s compositions and arrangements for an octet; in a review back in 1964, the Times’s John S. Wilson thought that the charts were too heavy and underrehearsed—unfortunately, Thompson got precious few opportunities to work in the expanded format. Although far from perfect, and possibly not up to the leader’s own exacting standards, the performances here shine because of the excellent soloists (including pianist Hank Jones and trombonist Benny Powell in addition to Thompson) and the high quality of the leader’s tunes.
On both sets, octet and quartet, Thompson features one of his most distinctive compositions, “The World Awakes.” According to annotator and Thompson discographer Noal Cohen, this 1956 original is simply an F-minor blues, but Thompson does so much with it that it seems infinitely richer. Playing mostly soprano in the latter part of his career (he was a modernist pioneer on the instrument) he lays out the basic blues melody, then plays an incredibly catchy second strain. There’s a Latin rhythm underneath and a pop element too; it’s the kind of tune that Quincy Jones, Thompson’s fellow American in Paris a few years earlier, could have handily orchestrated into a funky chart hit. The writing and playing, overall, are so outstanding on these two shows that it seems especially tragic that Thompson left music for the last 30 years of his life and all but vanished from the map.

* * *

Jimmy Rushing (1901-72) was a blues-centric vocalist who spent the most celebrated part of his career as Count Basie’s “boy singer.” He toured and recorded as a soloist in the 1950s and ’60s, but while most of Rushing’s studio albums have been reissued, no one has yet unearthed and released a whole live show by the famous “Mr. Five by Five.” “The Scene: Live in New York” (High Note) was taken from several sets, at least one of which was from the Half Note, where Rushing worked regularly with the legendary two-tenor team of Zoot Sims and Al Cohn (and the young pianist Dave Frishberg).

The bulk of this first-rate set is given to hard-swinging treatments of jazz standards that Rushing undoubtedly had been singing since they were brand new in the ’20s: “Deed I Do,” “I Can’t Believe That You’re in Love With Me” and “I Want a Little Girl.” Rushing heats up these old chestnuts with his unique combination of a big, heavy voice and a light-footed and fast rhythmic sense of time. No one could do what Rushing does on Don Redman and Andy Razaf’s “Gee Baby Ain’t I Good to You?,” one of the original soul ballads. This is truly crooning the blues; he’s equal parts Leroy Carr and Bing Crosby, singing the number tenderly but with an undercurrent of aggression.

Although Rushing always insisted that he was more than a blues shouter, the set is highlighted by several extended blues features, all elaborations on the best-known numbers from his Basie tenure. To Rushing, a blues is a blues is a blues: One track starts out with the opening of “Goin’ to Chicago” and then spontaneously detours through “Jimmy’s Blues” (“I got a mind to ramble . . . ”). The last track on the disc begins with “Good Morning Blues” and then morphs into “Harvard Blues,” “Jimmy’s Blues” (again), and—a sign that these were recorded during separate sessions—“Goin’ to Chicago.” Both songs end with Rushing’s signature tag (from “Baby, Don’t Tell on Me”): “Little Jimmy Rushing has been here and gone.” The one blues that follows a wholly familiar trajectory is his cover of Joe Williams’s hit “Everyday I Have the Blues.” On most of these, Rushing exhorts his co-stars to “come on and blow the blues,” but as excellent as Sims, Cohn and Mr. Frishberg are, they can’t do what Jimmy Rushing can do with a blues. No one could.

Listen to clips from Jimmy Rushing’s recent album, “The Scene: Live in New York”:

(TMZ) B.B. King is officially not allowed to sing the Blues anymore -- we just got our hands on a lawsuit that says he's already made over $100 million in the 21st century.

King is being sued by his former business manager, Floyd Leiberman, who claims he helped B.B. make the massive amount of money from 2000 - 2008 -- only to be left high and dry when it came to getting his cut of the profits.

In the lawsuit, filed in Supreme Court of New York, Floyd also lists a ton of other ways he's been cut out of King's vast fortune. Floyd is suing King for at least $1.5 million.

DUKE ROBILLARD:STOMP THE BLUES

Duke Robillard joins Elwood to talk about STOMP THE BLUES, his salute to the jump and jive blues of the 1940’s and 50's. He talks about how he developed his eclectic style of playing, with Roomful of Blues, the Fabulous Thunderbirds, and by backing people like Bob Dylan and Tom Waits. Elwood and Duke dig deeper into the big band blues sound with classic tracks from Louis Armstrong and Wynonie Harris. And some lucky listeners will get to take home the debut album, WHITE SUGAR by the British player, Joanne Shaw Taylor. She is a combination of Dusty Springfield and Stevie Ray Vaughan, and she is very good. All that, plus a taste of the new record, MY WALKING STICK, from the great veteran Vancouver bluesman, Jim Byrnes.
