A review of our records indicates you may not have been issued an ADA Certificate of Compliance for your files and posting at the business!
Maintaining a current certificate helps in many ways:
- Fair Business Practices: By offering equal access to goods and services to those with disabilities, you are performing your civic duty and not discriminating by denying access to those with accessibility challenges.
- Law Suit Defense: Many organizations make unscheduled visits to public businesses to ensure compliance. Unfortunately, they DO NOT warn business owners before filing a law suit. Maintaining a current Compliance Certificate can help avoid these law suits.
- Legal Fee Reimbursement: If an individual files a law suit against a business with a current Compliance Certificate, we have been involved in cases where the Plaintiff has to pay the Defendant's legal fees!
- Additional Business Revenue: By providing equal access to all to goods and services provided at the Business, this provides opportunities for additional revenue!
If you have made the recommended modifications to the property, please contact us to schedule your Follow Up Inspection. We will verify and update your ADA Compliance Survey AND issue a current ADA Compliance Certificate.
If you have NOT made the recommended modifications and feel that doing so may harm your business financially or may not be physically possible, CONTACT US. We can review your individual situation and possibly provide an argument for full compliance being "Not Readily Achievable". Keep in mind GRANDFATHERING is NOT recognized as a defense in law suits against businesses for non-compliance. The only way to overcome this is to include an argument from an ADA Expert (Kross Inspectors) explaining why certain items are Not Readily Achievable. With this argument included in your Survey, you CAN be issued an ADA Compliance Certificate!
